Several police officers responded to a 911 report of a naked woman tied to a tree in Point Defiance Park in Tacoma. .
Police Spokesman Mark Fulghum said officers talked with the woman and a man Tuesday in the Owen Beach area and determined it was a "consensual rendezvous."
But why wasn't anyone arrested?
Mark Fulghum said the man and woman were separated at the scene and questioned individually to ensure that no one was being assaulted.
"She was very forthcoming about what was going on and that it was consensual and both were out there by their own free will." Fulghum said.
Police identified the woman only as a 19-year old from Gig Harbor.
Pierce County prosecutor Mark Lindquist said that officers have wide discretion to arrest individuals violating park decency rules. .
"The police officers in the field make a decision to arrest or to cite, and then a police report comes to our office and we review that police report and we make a decision as to whether or not to prosecute. We only prosecute about 60-percent of the cases that come into our office." Lindquist said. Even if the couple was arrested, it would only have been a misdemeanor charge for public indecency.
